§ 147‑33.104. (Effective July 1, 2010) Purchase by State agencies and governmental entitiesof certain computer equipment prohibited.
(a) The exemptions setout in G.S. 147‑33.80 do not apply to this section.
(b) No State agency,political subdivision of the State, or other public body shall purchasecomputer equipment or televisions, as defined in G.S. 130A‑309.91, fromany manufacturer that the Secretary determines is not in compliance with therequirements of G.S. 130A‑309.93 or G.S. 130A‑309.93A as determinedfrom the list provided by the Department of Environment and Natural Resourcespursuant to G.S. 130A‑309.95(1). The Secretary shall issue writtenfindings upon a determination of noncompliance. A determination ofnoncompliance by the Secretary is reviewable under Article 3 of Chapter 150B ofthe General Statutes.
(c) The Office ofInformation Technology Services shall make the list available to politicalsubdivisions of the State and other public bodies. A manufacturer that is notin compliance with the requirements of G.S. 130A‑309.93 shall not sell oroffer for sale computer equipment or televisions to the State, a politicalsubdivision of the State, or other public body.
