§ 143B‑168.14. Localpartnerships; conditions.
(a) In order to receiveState funds, the following conditions shall be met:
(1) Each localpartnership shall develop a comprehensive, collaborative, long‑range planof services to children and families in the service‑delivery area. Noexisting local, private, nonprofit 501(c)(3) organization, other than oneestablished on or after July 1, 1993, and that meets the guidelines for localpartnerships as established under this Part, shall be eligible to apply to serveas the local partnership for the purpose of this Part. The Board of the NorthCarolina Partnership may authorize exceptions to this eligibility requirement.
(2) Each localpartnership shall agree to adopt procedures for its operations that arecomparable to those of Article 33C of Chapter 143 of the General Statutes, theOpen Meetings Law, and Chapter 132 of the General Statutes, the Public RecordsLaw, and provide for enforcement by the Department. The procedures may providefor the confidentiality of personnel files comparable to Article 7 of Chapter126 of the General Statutes.
(3) Each localpartnership shall adopt procedures to ensure that all personnel who provideservices to young children and their families under this Part know andunderstand their responsibility to report suspected child abuse, neglect, ordependency, as defined in G.S. 7B‑101.
(4) Each localpartnership shall participate in the uniform, standard fiscal accountabilityplan developed and adopted by the North Carolina Partnership.
(b) Each localpartnership shall be subject to audit and review by the North CarolinaPartnership. The North Carolina Partnership shall contract for annual financialand compliance audits of local partnerships that are rated "needsimprovement" in performance assessments authorized in G.S. 143B‑168.12(a)(7).Local partnerships that are rated "superior" or"satisfactory" in performance assessments authorized in G.S. 143B‑168.12(a)(7)shall undergo biennial financial and compliance audits as contracted for by theNorth Carolina Partnership. The North Carolina Partnership shall provide theState Auditor with a copy of each audit conducted pursuant to this subsection. (1993 (Reg. Sess., 1994), c.766, s. 1; 1996, 2nd Ex.
