§ 143B‑139.3. Department of Health and Human Services authority to contract with otherentities.
(a) The Department of Health and Human Services is authorized tocontract with any governmental agency, person, association, or corporation forthe accomplishment of its duties and responsibilities provided that theexpenditure of funds pursuant to such contracts shall be for the purposes forwhich the funds were appropriated and is not otherwise prohibited by law.
(b) The Department is authorized to enter into contracts withand to act as intermediary between any federal government agency and any countyof this State for the purpose of assisting the county to recover moniesexpended by a county‑funded financial assistance program; and, as acondition of such assistance, the county shall agree to hold and save harmlessthe Department against any claims, loss, or expense which the Department mightincur under the contracts by reason of any erroneous, unlawful, or tortious actor omission of the county or its officials, agents, or employees.
