§ 143B‑131.6. Roanoke Island Commission Members; terms; vacancies; expenses; officers.
(a) The Commission shall consist of 24 voting members appointedas follows:
(1) Six members appointed by the Governor;
(2) Six members appointed by the General Assembly upon therecommendation of the President Pro Tempore of the Senate, at least two of whomreside in Dare County;
(3) Six members appointed by the General Assembly upon therecommendation of the Speaker of the House of Representatives, at least two ofwhom reside in Dare County; and
(4) The following persons, or their designees, ex officio:
a. The Governor;
b. The Attorney General;
c. The Secretary of the Department of Cultural Resources;
d. The Secretary of the Department of Transportation;
e. The Chair of the Dare County Board of Commissioners; and
f. The Mayor of Manteo.
(b) Members shall serve for two‑year terms, with noprohibition against being reappointed, except initial appointments shall be forterms as follows:
(1) The Governor shall initially appoint three members for aterm of two years and three members for a term of three years.
(2) The General Assembly upon the recommendation of thePresident Pro Tempore of the Senate shall initially appoint three members for aterm of two years and three members for a term of three years.
(3) The General Assembly upon the recommendation of the Speakerof the House of Representatives shall initially appoint three members for aterm of two years and three members for a term of three years.
Initialterms shall commence on October 1, 1994.
(c) The Governor shall appoint a chair biennially from among themembership of the Commission. The initial term of the chair shall commence onOctober 1, 1994. The Commission shall elect from its membership a vice‑chair,a secretary, and treasurer to serve two‑year terms. The Commission in itsdiscretion may appoint a historian to serve at its pleasure. Initial termsshall commence on October 1, 1994.
(d) A vacancy in the Commission resulting from the resignationof a member or otherwise, shall be filled in the same manner in which theoriginal appointment was made, and the term shall be for the balance of theunexpired term. Vacancies in appointments made by the General Assembly shall befilled in accordance with G.S. 120‑122.
(e) The Commission members shall receive no salary as a resultof serving on the Commission but shall receive per diem, subsistence, andtravel expenses in accordance with the provisions of G.S. 138‑5 and G.S.138‑6, as applicable. When approved by the Commission, members may bereimbursed for subsistence and travel expenses in excess of the statutoryamount.
(f) Members may be removed in accordance with G.S. 143B‑13as if that section applied to this Part.
(g) The chair shall convene the Commission. Meetings shall beheld as often as necessary, but not less than two times a year.
(h) A majority of the members of the Commission shall constitutea quorum for the transaction of business. The affirmative vote of a majority ofthe members present at meetings of the Commission shall be necessary for actionto be taken by the Commission.
(i) The Commission shall make its recommendations by March 15of each year that terms expire for appointments for terms commencing July 1 ofthat year; provided the initial appointments for terms commencing October 1,1994, shall be made upon recommendation of the Roanoke Island HistoricalAssociation.
