§ 143‑135.38. Use ofother standard when standard not practicable.
When the Department, publicagency, and the design team determine that the energy‑efficiency standardor the water use standard required under G.S. 143‑135.37 is notpracticable for a major facility construction or renovation project, then itmust be determined by the State Building Commission if the standard is notpracticable for the major facility construction or renovation project. If theState Building Commission determines the standard is not practicable for thatproject, the State Building Commission shall determine which standard ispracticable for the design and construction for that major facilityconstruction or renovation project. If a standard required under G.S. 143‑135.37is not followed for that project, the State Building Commission shall reportthis information and the reasons to the Department within 90 days of itsdetermination.
