§ 14‑27.5. Second‑degreesexual offense.
(a) A person is guiltyof a sexual offense in the second degree if the person engages in a sexual actwith another person:
(1) By force and againstthe will of the other person; or
(2) Who is mentallydisabled, mentally incapacitated, or physically helpless, and the personperforming the act knows or should reasonably know that the other person ismentally disabled, mentally incapacitated, or physically helpless.
