§ 136-12. Reports to General Assembly; Transportation Improvement Program submitted to members and staff of General Assembly.

§ 136‑12.  Reports toGeneral Assembly; Transportation Improvement Program submitted to members andstaff of General Assembly.

(a)        The Department ofTransportation shall, on or before the tenth day after the convening of eachregular session of the General Assembly of North Carolina, make a full printed,detailed report to the General Assembly, showing the construction andmaintenance work and the cost of the same, receipts of license fees, anddisbursements of the Department of Transportation, and such other data as maybe of interest in connection with the work of the Department of Transportation.A full account of each road project shall be kept by and under the direction ofthe Department of Transportation or its representatives, to ascertain at any timethe expenditures and the liabilities against all projects; also records ofcontracts and force account work. The account records, together with allsupporting documents, shall be open at all times to the inspection of theGovernor or road authorities of any county, or their authorizedrepresentatives, and copies thereof shall be furnished such officials uponrequest.

(a1)      The Department ofTransportation shall report quarterly beginning on October 15, 1996, and thenon the fifteenth of the month following the end of the fiscal quarter, to theJoint Legislative Transportation Oversight Committee on all projects to bebuilt with funds obligated using the cash flow provisions of G.S. 143C‑6‑11.The report shall contain a list of the projects and the amount obligated inanticipation of revenues for each year of the project.

(b)        At least 30 daysbefore it approves a Transportation Improvement Program in accordance with G.S.143B‑350(f)(4) or approves interim changes to a TransportationImprovement Program, the Department shall submit the proposed TransportationImprovement Program or proposed interim changes to a Transportation ImprovementProgram to the following members and staff of the General Assembly:

(1)        The Speaker and theSpeaker Pro Tempore of the House of Representatives;

(2)        The LieutenantGovernor and the President Pro Tempore of the Senate;

(3)        The Chairs of theHouse and Senate Appropriations Committees;

(4)        Each member of theJoint Legislative Transportation Oversight Committee; and

(5)        The Fiscal ResearchDivision of the Legislative Services Commission.
