§ 131E‑310. Confidentiality of medical information.
Any data or information pertaining to the diagnosis, treatment, orhealth of any beneficiary or applicant obtained from the person or from anyprovider by any provider sponsored organization or by any provider actingpursuant to its provider contract with a provider sponsored organization shallbe held in confidence and shall not be disclosed to any person except to theextent that it may be necessary to carry out the purposes of this Article; orupon the express consent of the beneficiary or applicant; or pursuant tostatute; or pursuant to court order for the production of evidence or thediscovery thereof; or in the event of claim or litigation between such personand the provider sponsored organization wherein such data or information ispertinent. A provider sponsored organization shall be entitled to claim anystatutory privileges against such disclosure which the provider who furnishedsuch information to the provider sponsored organization is entitled to claim.
