§ 131E‑182. Application.
(a) The Department inits rules shall establish schedules for submission and review of completedapplications. The schedules shall provide that applications for similarproposals in the same service area will be reviewed together.
(b) An application fora certificate of need shall be made on forms provided by the Department. Theapplication forms, which may vary according to the type of proposal, shallrequire such information as the Department, by its rules deems necessary toconduct the review. An applicant shall be required to furnish only thatinformation necessary to determine whether the proposed new institutionalhealth service is consistent with the review criteria implemented under G.S.131E‑183 and with duly adopted standards, plans and criteria.
(c) An application feeis imposed on an applicant for a certificate of need. An applicant must submitthe fee with the application. The fee is not refundable, regardless of whethera certificate of need is issued. Fees collected under this section shall becredited to the General Fund as nontax revenue. The application fee is fivethousand dollars ($5,000) plus an amount equal to three‑tenths of onepercent (.3%) of the amount of the capital expenditure proposed in theapplication that exceeds one million dollars ($1,000,000). In no event may thefee exceed fifty thousand dollars ($50,000).
