§ 131E‑154.14. NC NOVAprogram established.
(a) The Department ofHealth and Human Services shall establish the NC NOVA program.
(b) The Departmentshall adopt rules to implement the NC NOVA program in accordance with thecriteria and protocols established by the NC NOVA Partner Team and detailed inthe NC NOVA Provider Information Manual.
(c) Any informationsubmitted by applicants or obtained by the independent review organizationrelated to NC NOVA, as well as annual turnover data voluntarily submitted byhome care agencies, adult care homes, and nursing facilities for the purposesof assessing statewide turnover trends, shall not be considered a public recordunder G.S. 132‑1.
(d) Any licensed homecare agency, adult care home, or nursing home that is determined not to havemet the criteria for NC NOVA designation may reapply at intervals specified bythe NC NOVA Partner Team and detailed in the NC NOVA Provider InformationManual.
(e) The Department ofHealth and Human Services, Division of Health Service Regulation, shall issue aNC NOVA special licensure designation document to any licensed home careagency, adult care home, or nursing home that is determined by the independentreview organization to have met the criteria for NC NOVA designation. The speciallicensure designation document shall be in addition to the operating licenseissued by the Division.
(f) The Division ofHealth Service Regulation shall issue the NC NOVA special licensure document tosuccessful applicants within 30 days of notification by the independent revieworganization.
(g) The NC NOVA speciallicensure designation shall be in effect for a two‑year period unless theprovider has a change in ownership.
(1) Upon a change inownership, if the new owner wishes to continue the NC NOVA designation, the newowner must communicate the desire in writing to the independent revieworganization within 30 days of the effective date of the change of ownershipand proceed with an expedited review in accordance with procedures detailed bythe NC NOVA Partner Team and included in the NC NOVA Provider InformationManual.
a. If the new ownercontinues to meet the NC NOVA criteria, based upon the expedited review, thespecial licensure designation will remain in effect for the remainder of thetwo‑year period.
b. If the new ownerfails to meet NC NOVA criteria, the special designation document shall beimmediately returned to the Division of Health Service Regulation. The newowner may reapply for NC NOVA designation under subsection (e) of this section.
(2) Within 30 days ofthe effective date of the change of ownership, if the new owner fails to notifythe independent review organization in writing of the desire to retain thespecial licensure designation by undergoing an expedited review, the designationwill become null and void, and the special designation document must beimmediately returned to the Division of Health Service Regulation.
