§130A‑49. Declaration that district exists; status of industrial villageswithin boundaries of district.
(a) If, after therequired public hearing, the Commission and the county commissioners determinethat a district shall be created for the purposes stated in the petition, theCommission shall adopt a resolution defining the boundaries of the district anddeclaring the territory within the boundaries to be a sanitary district. TheCommission may make minor deviation in defining the boundaries from thoseprescribed in the petition when it determines the change to be in the interestof the public health.
(b) The owner orcontroller of an industrial plant may make application requesting that theplant or the plant and its contiguous village be included within or excludedfrom the sanitary district. The application shall be filed with the Commissionon or before the date of the public hearing. If an application is properlyfiled, the Commission shall include or exclude the industrial plant andcontiguous village in accordance with the application.
