§ 130A‑342. Residentialwastewater treatment systems.
(a) Individualresidential wastewater treatment systems that are approved and listed inaccordance with the standards adopted by the National Sanitation Foundation,Inc. for Class I residential wastewater treatment systems, as set out inStandard 40 of the National Sanitation Foundation, Inc., (as approved 13January 2001) as amended, shall be permitted under rules adopted by theCommission. The Commission may establish standards in addition to those set bythe National Sanitation Foundation, Inc.
(b) A permitted systemshall be operated and maintained by a certified wastewater treatment facilityoperator.
(c) Each county, inwhich one or more residential wastewater treatment systems permitted pursuant tothis section are in use, shall document the performance of each system andreport the results to the Department annually.
