§ 130A‑309.93A. (Foreffective dates, see note) Requirements for television manufacturers.
(a) Each televisionmanufacturer, before selling or offering for sale televisions in the State,shall register with the Department and, at the time of registration, shall payan initial registration fee of two thousand five hundred dollars ($2,500) tothe Department. An initial registration shall be valid from the day ofregistration through the last day of the fiscal year in which the registrationfee was paid. A television manufacturer that has registered shall pay an annualrenewal registration fee of two thousand five hundred dollars ($2,500) to theDepartment. The annual renewal registration fee shall be paid to the Departmenteach fiscal year no later than 30 June of the previous fiscal year. TheDepartment may charge an administrative fee of up to one hundred fifty dollars($150.00) for failure to pay the permit fee by 30 June of each year. Theproceeds of these fees shall be credited to the Television Management Account.A television manufacturer that sells 1,000 televisions or less per year isexempt from the requirement to pay the registration fee and the annual renewalfee imposed by this subsection.
(b) A televisionmanufacturer shall not sell or offer to sell any television in this Stateunless a visible, permanent label clearly identifying the manufacturer of thatdevice is affixed to the equipment.
(c) The obligation torecycle televisions shall be allocated to each television manufacturer based onthe television manufacturer's market share. A television manufacturer mustannually recycle or arrange for the recycling of its market share oftelevisions pursuant to this section.
(d) A televisionmanufacturer shall conduct and document due diligence assessments of therecyclers the manufacturer contracts with, including an assessment ofcompliance with environmentally sound recovery standards adopted by theDepartment.
(e) A televisionmanufacturer shall provide the Department with contact information for the manufacturer'sdesignated agent or employee whom the Department may contact for informationrelated to the manufacturer's compliance with the requirements of this section.
(f) A televisionmanufacturer may fulfill the requirements of this section either individuallyor in participation with other television manufacturers.
(g) A televisionmanufacturer shall report to the Department by 1 October of each year the totalweight of televisions the manufacturer collected and recycled in the Stateduring the previous year. (2008‑198, s. 11.4; 2008‑208, ss. 1, 7;2009‑484, s. 16(a), (b); 2009‑550, s. 10(a), (b).)
