§130A‑309.24. Permits for used oil recycling facilities.
(a) Each person whointends to operate, modify, or close a used oil recycling facility shall obtainan operation or closure permit from the Department prior to operating,modifying, or closing the facility.
(b) By 1 January 1992,the Department shall develop a permitting system for used oil recyclingfacilities after reviewing and considering the applicability of the permitsystem for hazardous waste treatment, storage, or disposal facilities.
(c) Permits shall notbe required under this section for the burning of used oil as a fuel, provided:
(1) A valid air permitissued by the Department is in effect for the facility; and
(2) The facility burnsused oil in accordance with applicable United States Environmental ProtectionAgency regulations, local government regulations, and the requirements andconditions of its air permit.
(d) No permit isrequired under this section for the use of used oil for the beneficiation orflotation of phosphate rock. (1989, c. 784, s. 2.)
