§ 130A‑295.03. Additional requirement for hazardous waste disposal facilities; hazardous wasteto be placed in containers.
(a) For purposes ofthis section, the term "container" means any portable device intowhich waste is placed for storage, transportation, treatment, disposal, orother handling, and includes the first enclosure which encompasses the waste.
(b) All hazardous wasteshall be placed in containers for disposal, except as the Commission shallprovide for by rule. The Commission shall adopt standards for the design andconstruction of containers for disposal. Standards for containers may vary fordifferent types of waste. The standards for disposal containers may supplementor duplicate any of the performance or engineering standards for hazardouswaste disposal facilities required under State or federal law; however, theperformance or engineering standards for hazardous waste disposal facilitiesare separate and cumulative, and the performance or engineering standards forhazardous waste disposal facilities and containers may not substitute for orreplace one another.
