§127A‑98. Regulations enforced on active State service.
Whenever any portion of themilitia shall be called into active State service to execute the law, securethe safety of persons and property, suppress riots or insurrections, repelinvasions or provide disaster relief, the provisions of the Uniform Code ofMilitary Justice of the United States, governing the armed forces of the UnitedStates, and the regulations prescribed for the armed forces of the UnitedStates, and the regulations issued thereunder, shall be enforced and regardedas part of this Chapter until said forces shall be relieved from such duty. Asto offenses committed when such provisions of the Uniform Code of MilitaryJustice of the United States are so enforced, courts‑martial shall possess,in addition to the jurisdiction and power of sentence and punishment hereinvested in them, all additional jurisdiction and power of sentence andpunishment exercisable by like courts under such provisions of the Uniform Codeof Military Justice of the United States or regulations or laws governing theUnited States armed forces or the customs and usages thereof; but no punishmentunder such Code which shall extend to the taking of life shall in any case beinflicted except in case of war, invasion, or insurrection, declared by aproclamation of the Governor to exist and then only after approval by theGovernor of the sentence inflicting such punishment. Imprisonment other than inguardhouse shall be executed in county jails or other prisons designated by theGovernor for that purpose.
