§121‑11. Procedures where assistance extended to cities, counties, andother agencies or individuals.
In consideration of the publicpurpose thereby achieved, the Department of Cultural Resources may assist anycounty, city, or other political subdivision, corporation or organization, orprivate individual in the acquisition, maintenance, preservation, restoration,or development of historic or archaeological property by providing a portion ofthe cost therefor: Provided, that the Department of Cultural Resources may notmake any acquisition, maintenance, preservation, restoration, or development ofany property, nor any assistance for any property, nor any contribution forthese purposes, until:
(1) The property orproperties shall have been approved for these purposes by the Department ofCultural Resources according to criteria adopted by the North CarolinaHistorical Commission,
(2) The report andrecommendations of the Commission have been received and considered by theDepartment of Cultural Resources, and
(3) The Department hasfound that there is a feasible and practical method of providing funds for theacquisition, restoration, preservation, maintenance, and operation of suchproperty.
In all cases where assistanceis extended by the Department of Cultural Resources to nonstate owners ofproperty, whether from State funds or otherwise, it shall be a condition ofassistance that
(1) The propertyassisted shall, upon its acquisition or restoration, be made accessible to thepublic at such times and upon such terms as the Department of CulturalResources shall by rule prescribe;
(2) That the plans forpreservation, restoration, and development be reviewed and approved by theDepartment of Cultural Resources;
(3) That the expenditureof such funds be supervised by the Department of Cultural Resources; and
(4) That suchexpenditures be accounted to the Department in a manner and at such times asare satisfactory to it.
In further consideration ofthe public purpose thereby achieved, the Department of Cultural Resources mayassist any county, city, or other political subdivision, or corporationnonprofit history museum in the development of interpretive, security orclimate control programs or projects. Provided, that the Department of CulturalResources may not make any assistance or contribution from State funds for aprogram or project until:
(1) The program orproject shall have been approved for these purposes by the Department ofCultural Resources according to criteria adopted by the North Carolina HistoricalCommission;
(2) The report andrecommendations of the Commission have been received and considered by theDepartment of Cultural Resources; and
(3) The Department hasfound that there is a feasible and practical method of providing funds for themaintenance and operation of such history museum.
In all cases where assistanceis extended by the Department of Cultural Resources to nonstate owners ofhistory museums, whether from State funds or otherwise, it shall be a conditionof assistance that:
(1) The museum assistedshall be accessible to the public at such times and upon such terms as theDepartment of Cultural Resources shall by rule prescribe;
(2) Plans for thedevelopment of museum programs or projects be reviewed and approved by theDepartment of Cultural Resources;
(3) The expenditure ofsuch funds be supervised by the Department of Cultural Resources; and
