§ 120‑217. Commissionmembership; terms; compensation.
(a) The Commissionshall consist of 26 members, as follows:
(1) Eleven membersappointed by the Speaker of the House of Representatives, among them:
a. Five shall bemembers of the House of Representatives at the time of their appointment, ofwhom at least one shall also serve on the House of RepresentativesAppropriations Subcommittee on Health and Human Services, one of whom alsoserves on the Joint Legislative Education Oversight Committee, one of whom alsoserves on the Joint Legislative Oversight Committee on Mental Health,Developmental Disabilities, and Substance Abuse Services, and one of whom alsoserves on the House of Representatives Appropriations Subcommittee on Justiceand Public Safety,
b. One shall be thedirector of a local health department,
c. One shall be thedirector of a county department of social services,
d. One shall be theparent of a child who is at risk for behavioral, social, health, or safetyproblems or academic failure,
e. One shall be alicensed physician who is knowledgeable about the health needs of children andyouth,
f. One shall be achief district court judge recommended by the Council of Chief District Judges,and
g. One shall be arepresentative from the Covenant with North Carolina Children.
(2) Eleven membersappointed by the President Pro Tempore of the Senate, as follows:
a. Five shall bemembers of the Senate at the time of their appointment, of whom at least oneshall also serve on the Senate Appropriations Committee on Health and HumanServices, at least one of whom shall also serve on the Joint LegislativeEducation Oversight Committee, at least one of whom shall also serve on theJoint Legislative Oversight Committee on Mental Health, Developmental Disabilities,and Substance Abuse Services, and at least one of whom also serves on theSenate Appropriations Committee on Justice and Public Safety,
b. One shall be thedirector of a mental health area authority,
c. One shall be arepresentative of the Association of County Commissioners,
d. One shall be arepresentative of a local board of education,
e. One shall be alicensed attorney whose practice includes the representation of parents accusedof criminal or civil abuse or neglect,
f. One shall be achief district court judge recommended by the Council of Chief District Judges,
g. One shall be arepresentative from Action for Children of North Carolina, and
h. One shall be arepresentative from the North Carolina Child Fatality Task Force.
(3) The following shallserve ex officio as nonvoting members of the Commission:
a. The Secretary ofHealth and Human Services, or the Secretary's designee,
b. The StateSuperintendent of Public Instruction, or the Superintendent's designee,
c. The Secretary ofAdministration, or the Secretary's designee, and
d. The Director of theAdministrative Office of the Courts, or the Director's designee.
(b) Any vacancy shallbe filled by the appointing authority who made the initial appointment and by aperson having the same qualification. Members' terms shall last for two years.Members may be appointed to a maximum of three consecutive terms and may beappointed again after having been off the Commission for two years.
(c) Commission membersshall receive no salary as a result of serving on the Commission and the TaskForce on the Coordination of Children's Services but shall receive necessarysubsistence and travel expenses in accordance with G.S. 120‑3.1, 138‑5,and 138‑6, as applicable.
