§ 115C‑106.2. Purposes.
(a) The purposes ofthis Article are to (i) ensure that all children with disabilities ages threethrough 21 who reside in this State have available to them a free appropriatepublic education that emphasizes special education and related servicesdesigned to meet their unique needs and prepares them for further education,employment, and independent living; (ii) ensure that the rights of thesechildren and their parents are protected; and (iii) enable the State Board ofEducation and local educational agencies to provide for the education of allchildren with disabilities.
(b) In addition to thepurposes listed in subsection (a) of this section, the purpose of this Articleis to enable the State Board of Education and local educational agencies toimplement IDEA in this State. If this Article is silent or conflicts with IDEA,and if IDEA has specific language that is mandatory, then IDEA controls.
(c) Notwithstanding anyother section of this Article, the State Board of Education may set standardsfor the education of children with disabilities that are higher than thoserequired by IDEA.
