§ 114‑19.8. Criminal record checks ofapplicants for auctioneer, apprentice auctioneer, or auction firm license.
The Department of Justice may provide to the North Carolina AuctioneersCommission from the State and National Repositories of Criminal Histories thecriminal history of any applicant for an auctioneer's license under Chapter 85Bof the General Statutes. Along with the request, the Commission shall provideto the Department of Justice the fingerprints of the applicant, a form signedby the applicant consenting to the criminal record check and the use offingerprints and other identifying information required by the State orNational Repositories, and any additional information required by theDepartment of Justice. The applicant's fingerprints shall be forwarded to theState Bureau of Investigation for a check of the State's criminal historyrecord file, and the State Bureau of Investigation shall forward a set offingerprints to the Federal Bureau of Investigation for a national criminalhistory record check. The Commission shall keep all information obtainedpursuant to this section confidential. The Department of Justice may charge afee to offset the cost incurred by it to conduct a criminal record check underthis section. The fee shall not exceed the actual cost of locating, editing,researching, and retrieving the information. (1999‑142, s. 9; 2000‑140, s. 59(c); 2003‑214, s.1(2).)
