§ 113A‑255. Clean WaterManagement Trust Fund: Board of Trustees established; membershipqualifications; vacancies; meetings and meeting facilities.
(a) Board of TrusteesEstablished. There is established the Clean Water Management Trust Fund Boardof Trustees. The Clean Water Management Trust Fund Board of Trustees shall beadministratively located within the Department of Environment and NaturalResources but shall be independent of the Department.
(b) Membership. TheClean Water Management Trust Fund Board of Trustees shall be composed of 21members appointed to four‑year terms as follows:
(1) One member appointedby the Governor to a term that expires on 1 July of years that precede by oneyear those years that are evenly divisible by four.
(2) One member appointedby the Governor to a term that expires on 1 July of years that precede by oneyear those years that are evenly divisible by four.
(3) One member appointedby the Governor to a term that expires on 1 July of years that are evenlydivisible by four.
(4) One member appointedby the Governor to a term that expires on 1 July of years that are evenlydivisible by four.
(5) One member appointedby the Governor to a term that expires on 1 July of years that follow by oneyear those years that are evenly divisible by four.
(6) One member appointedby the Governor to a term that expires on 1 July of years that follow by twoyears those years that are evenly divisible by four.
(7) One member appointedby the Governor to a term that expires on 1 July of years that follow by twoyears those years that are evenly divisible by four.
(8) One member appointedby the General Assembly upon the recommendation of the President Pro Tempore ofthe Senate to a term that expires on 1 July of years that precede by one yearthose years that are evenly divisible by four.
(9) One member appointedby the General Assembly upon the recommendation of the President Pro Tempore ofthe Senate to a term that expires on 1 July of years that precede by one yearthose years that are evenly divisible by four.
(10) One member appointedby the General Assembly upon the recommendation of the President Pro Tempore ofthe Senate to a term that expires on 1 July of years that are evenly divisibleby four.
(11) One member appointedby the General Assembly upon the recommendation of the President Pro Tempore ofthe Senate to a term that expires on 1 July of years that follow by one yearthose years that are evenly divisible by four.
(12) One member appointedby the General Assembly upon the recommendation of the President Pro Tempore ofthe Senate to a term that expires on 1 July of years that follow by one yearthose years that are evenly divisible by four.
(13) One member appointedby the General Assembly upon the recommendation of the President Pro Tempore ofthe Senate to a term that expires on 1 July of years that follow by two yearsthose years that are evenly divisible by four.
(14) One member appointedby the General Assembly upon the recommendation of the President Pro Tempore ofthe Senate to a term that expires on 1 July of years that follow by two yearsthose years that are evenly divisible by four.
(15) One member appointedby the General Assembly upon the recommendation of the Speaker of the House ofRepresentatives to a term that expires on 1 July of years that precede by oneyear those years that are evenly divisible by four.
(16) One member appointedby the General Assembly upon the recommendation of the Speaker of the House ofRepresentatives to a term that expires on 1 July of years that are evenlydivisible by four.
(17) One member appointedby the General Assembly upon the recommendation of the Speaker of the House ofRepresentatives to a term that expires on 1 July of years that are evenlydivisible by four.
(18) One member appointedby the General Assembly upon the recommendation of the Speaker of the House ofRepresentatives to a term that expires on 1 July of years that follow by oneyear those years that are evenly divisible by four.
(19) One member appointedby the General Assembly upon the recommendation of the Speaker of the House ofRepresentatives to a term that expires on 1 July of years that follow by oneyear those years that are evenly divisible by four.
(20) One member appointedby the General Assembly upon the recommendation of the Speaker of the House ofRepresentatives to a term that expires on 1 July of years that follow by twoyears those years that are evenly divisible by four.
(21) One member appointedby the General Assembly upon the recommendation of the Speaker of the House ofRepresentatives to a term that expires on 1 July of years that follow by twoyears those years that are evenly divisible by four.
(b1) Qualifications. Theoffice of Trustee is declared to be an office that may be held concurrently withany other executive or appointive office, under the authority of Article VI,Section 9, of the North Carolina Constitution. Persons appointed shall beknowledgeable in at least one of the following areas:
(1) Acquisition andmanagement of natural areas.
(2) Conservation andrestoration of water quality.
(3) Wildlife andfisheries habitats and resources.
(4) Environmentalmanagement.
(b2) Limitation on Lengthof Service. No member of the Board of Trustees shall serve more than twoconsecutive four‑year terms or a total of 10 years.
(c) Chair. TheGovernor shall appoint one member to serve as Chair of the Board of Trustees.
(d) Vacancies. Anappointment to fill a vacancy on the Board of Trustees created by theresignation, removal, disability, or death of a member shall be for the balanceof the unexpired term. Vacancies in appointments made by the General Assemblyshall be filled as provided in G.S. 120‑122.
(e) Frequency ofMeetings. The Board of Trustees shall meet at least twice each year and mayhold special meetings at the call of the Chair or a majority of the members.
(e1) Quorum. A majorityof the membership of the Board of Trustees constitutes a quorum for thetransaction of business.
(f) Per Diem andExpenses. Each member of the Board of Trustees shall receive per diem andnecessary travel and subsistence expenses in accordance with the provisions ofG.S. 138‑5. Per diem, subsistence, and travel expenses of the Trusteesshall be paid from the Fund.
(g) Meeting Facilities. The Secretary of Environment and Natural Resources shall provide meetingfacilities for the Board of Trustees and its staff as requested by the Chair. (1996, 2nd Ex.
