§ 108A‑27.14. Corrective action.
(a) When any county fails to meet acceptable levels ofperformance, the Department may take one or more of the following actions toassist the county in meeting its Work First goals:
(1) Notify the county of the deficiencies and add additionalmonitoring and reporting requirements.
(2) Require the county to develop and submit for approval by theDepartment a corrective action plan.
(b) If any Standard Program County fails to meet acceptablelevels of performance for two consecutive years, or fails to comply with acorrective action plan developed pursuant to this section, the Department mayassume control of the county's Work First Program, appoint an administrator toadminister the county's Work First Program, and exercise the powers assumed toadminister the Work First Program either directly or through contract withprivate or public agencies. County funding shall continue at levels establishedby the State Plan when the State has assumed control of a county Work First Program.At no time after the State has assumed control of a Work First Program shall acounty withdraw funds previously obligated or appropriated to the Work FirstProgram.
(c) If an Electing County fails to achieve its Work FirstProgram goals for two consecutive years, or fails to comply with a correctiveaction plan developed pursuant to this section, and as a result the federalgovernment imposes a penalty upon the State, then the county shall lose itsElecting County status.
