§ 106‑667. Seizure, condemnation and sale.
Any lot of commercial fertilizer not in compliance with the provisionsof this Article shall be subject to seizure on complaint of the Commissioner toa court of competent jurisdiction in the area in which said commercialfertilizer is located. In the event the court finds the said commercialfertilizer to be in violation of this Article and orders the condemnation ofsaid commercial fertilizer, it shall be disposed of in any manner consistentwith the quality of the commercial fertilizer and the laws of the State;provided, that in no instance shall the disposition of said commercialfertilizer be ordered by the court without first giving the claimant anopportunity to apply to the court for the release of said commercial fertilizeror for permission to process or relabel said commercial fertilizer to bring itinto compliance with this Article.
