§ 106‑638. Authority of Board to adopt regulations, standards, etc.
The Board may adopt regulations and set procedures for the purpose ofcarrying out the provisions of this Article. The Board may adopt minimumstandards for colony strength and disease tolerance levels for hives rented forpollination of crops, and the Commissioner shall certify hives meeting thosestandards. The Board may adopt regulations to regulate or prohibit entranceinto North Carolina of bees or regulated articles to protect the bee and honeyindustry from bee diseases, disorders, overcrowding of honey pasture, or otherencroachments deemed by the Board not to be in the best interest of thebeekeepers of North Carolina. The Board may adopt regulations relating to, butshall not be limited to, providing for inspection of bees; and surveying anddeveloping regulations to control, eradicate, abate, prevent exposure to, orprevent the introduction of or movement into or within North Carolina of beediseases, disorders, pests or enemies of bees; or products that are a threat tobeekeeping in North Carolina. The diseases, disorders, and products regulatedshall include, but not be confined to bee diseases, poisons, bee pests, pollen,causal agents of disease, bee parasites and predators and toxic substances. TheBoard may regulate undesirable species or strains of bees including but notlimited to Brazilian or African strains of bees. Regulations may includearticles, exposed to infection or infestation, bees, honey, honeycomb, beeswax,beeswax refuse, royal jelly, containers, and beekeeping equipment to includesale, exposure and shipment of said and like items. The Board may adoptregulations governing beeyards or sites of commercial beekeepers. The Board isauthorized to adopt regulations and set fees for extra or special inspections,issuance of certificates, permits, registrations, and regulatory activities. (1977, c. 238, s. 5.)
