§1‑339.56. Exception; perishable property.
If, in the opinion of thesheriff, any personal property levied on under execution is perishable becausesubject to rapid deterioration, he shall forthwith report such levy, togetherwith a description of the property, to the clerk of the superior court, andrequest instructions as to the sale of such property. If the clerk thendetermines that the property is such perishable property, he shall thereuponorder a sale thereof to be held at such time and place and upon such notice tobe given in such manner and for such length of time as he deems advisable. Ifthe clerk determines that the property is not perishable, he shall order it tobe sold in the same manner as other nonperishable property. (1949,c. 719, s. 1.)
