§ 2407. Advisory council. 1. There is hereby established in the department the breast and cervical cancer detection and education program advisory council to be composed of twenty-one members who shall be appointed in the following manner: three shall be appointed by the temporary president of the senate and two by the minority leader of the senate; three shall be appointed by the speaker of the assembly and two by the minority leader of the assembly; eleven shall be appointed by the governor. The governor shall designate the chairperson of the advisory council. The members of the council shall be representative of the public, persons with breast or cervical cancer, local health departments, health care providers, and recognized experts in the provision of health services to all females, cancer research, or environmental health. The aforementioned appointing officials shall either replace or reappoint the members of such council for two year terms, according to the following schedule: (a) Effective July first, nineteen hundred ninety-three: Any three original appointees of the governor, one original appointee of the temporary president of the senate, and one original appointee of the speaker of the assembly; (b) Effective July first, nineteen hundred ninety-five: Any two of the remaining original appointees of the governor, the original appointee of the minority leader of the senate, the original appointee of the minority leader of the assembly; (c) Effective July first, nineteen hundred ninety-seven: The two remaining original appointees of the governor, the remaining original appointee of the temporary president of the senate, the remaining original appointee of the speaker of the assembly; (d) Effective December thirty-first, two thousand five: The eight new members of the advisory council shall be appointed; (e) Replacements or reappointments thereafter shall be made at the expiration of the term of each member, by the appointing official who originally appointed such member; and (f) Vacancies shall be filled by appointment in like manner for unexpired terms. 2. The advisory council shall be responsible for advising the commissioner with respect to the implementation of this article and shall make recommendations as to the selection of approved organizations and the standards to be established by the commissioner pursuant to section twenty-four hundred six of this title. The commissioner shall consult with the advisory council prior to developing standards for approved organizations, selecting approved organizations, making grants to such organizations and implementing the breast and cervical cancer detection and education program. 3. The advisory council shall perform an evaluation of the state's system for early detection and treatment of breast cancer and shall submit to the legislature and the governor a report detailing its findings and recommendations concerning the state's response to the high incidence of breast cancer. Such report shall be submitted no later than January first, nineteen hundred ninety-one. The department shall provide such information and assistance as the advisory council shall require in order to complete its report. 3-b. The advisory council shall obtain the department's review of statistical and qualitative data on the prevalence and incidence of cervical cancer. 3-c. The advisory council, in collaboration with the department, shall raise public awareness on the causes and nature of cervical cancer, personal risk factors, value of prevention, early detection, options fortesting, treatment costs, new technology, and medical care reimbursement. 3-d. The advisory council shall develop with the department a statewide comprehensive cervical cancer prevention plan and identify priority strategies and new technologies, which are effective in preventing and controlling the risk of cervical cancer. 3-e. The advisory council shall identify and examine the limitations of existing laws, regulations, programs, and services with regard to cervical cancer. 3-f. The advisory council shall facilitate coordination of and communication among state and local agencies and organizations regarding involvement in implementing and promoting the cervical cancer prevention plan. 3-g. The advisory council shall receive and consider reports and testimony from individuals, local health departments, community-based organizations, voluntary health organizations, and other public and private organizations statewide to learn about contributions to cervical cancer diagnosis, prevention, and treatment, and about ideas for improving cervical cancer prevention, diagnosis, and treatment in New York. 4. The advisory council shall meet at least three times a year, at the request of the chair. 5. The members of the council shall receive no compensation for their services, but shall be allowed their actual and necessary expenses incurred in performance of their duties.
