§ 13. Enforcement: against officers. The performance of any duty or the doing of any act enjoined, prescribed or required by this chapter, may be enforced by a proceeding pursuant to article seventy-eight of the civil practice law and rules at the instance of the department or of a local board of health, or of any citizen of full age resident of the municipality where the duty should be performed or the act done.
