§ 100.07 Commencement of action; effect of family court proceeding.    A  criminal  court  shall have concurrent jurisdiction over cognizable  family offenses, as defined in subdivision one of section 530.11 of this  chapter and in subdivision one of section eight hundred  twelve  of  the  family  court  act,  notwithstanding the fact that a family court has or  may be exercising jurisdiction over a petition under  article  eight  of  the  family  court  act containing substantially the same allegations as  are set forth in the accusatory instrument or indictment.
