470-A - Salary basis for computing retirement benefits; temporary.
§ 470-a. Salary basis for computing retirement benefits; temporary. If a guard or other employee in a state prison or reformatory or an employee of the department of correction shall retire pursuant to section four hundred and seventy of this chapter, the reduction of his salary, during all or as to any part of the year immediately preceding his retirement, made in accordance with a scale of percentage reductions prescribed by a law or laws enacted by the legislature at its annual sessions of the years nineteen hundred thirty-three and nineteen hundred thirty-four, shall not operate to reduce his retirement compensation or pension. The basis for computing his retirement compensation or pension of one-half or a proportion of one-half, as the case may be, of the salary paid to him for the year immediately preceding his retirement shall be his full salary on which the percentage reduction so prescribed is computed, according to the several pay-rolls, and which he would have been paid had such percentage reductions not been made or required.
