Section 400-A:6 Deputy Commissioner; Other Department Positions.
   I. The commissioner, subject to the approval of the governor, shall appoint a deputy commissioner of insurance who shall hold office for 5 years and until a successor has been appointed and qualified.
   II. The deputy commissioner of insurance shall perform such duties and exercise such powers of the commissioner pursuant to RSA Title XXXVII as the commissioner from time to time may authorize.
   III. When the office of the commissioner is vacant, or when the commissioner is unable to perform his duties because of mental or physical disability, the deputy commissioner of insurance shall be acting commissioner.
   III-a. There shall be a director of operations who shall be appointed by the commissioner of insurance. He or she shall serve at the pleasure of the commissioner during good behavior. When the offices of the commissioner and deputy commissioner are vacant, or when the commissioner or deputy commissioner is unable to perform his or her duties because of mental or physical disability, the director of operations shall be acting commissioner. The director of operations shall perform such duties and exercise such powers of the commissioner pursuant to RSA Title XXXVII as the commissioner from time to time may authorize.
   III-b. There shall be a director of examinations; who shall be appointed by the commissioner of insurance. He shall serve at the pleasure of the commissioner during good behavior. The director of examinations shall perform such duties and exercise such powers of the commissioner pursuant to RSA Title XXXVII as the commissioner from time to time may authorize.
   III-c. There shall be an actuary, who shall be appointed by the commissioner of insurance. He shall serve at the pleasure of the commissioner during good behavior. The actuary shall perform such duties and exercise such powers of the commissioner, pursuant to RSA title XXXVII, as the commissioner from time to time may authorize.
   III-d. There shall be a life, accident and health actuary, who shall be appointed by the commissioner of insurance. He shall serve at the pleasure of the commissioner during good behavior. The actuary shall perform such duties and exercise such powers of the commissioner, pursuant to this chapter, as the commissioner may authorize.
   IV, V. [Repealed.]
   VI. There shall be a workers' compensation analyst who shall be appointed by the commissioner of insurance who shall:
      (a) Review rate requests and filings;
      (b) Assist in the study of competitive pricing required under RSA 412:28, II;
      (c) Review and regulate the qualifications of insurers in cooperation with the department of labor;
      (d) Provide research assistance to the workers' compensation advisory council;
      (e) Review the performance of insurers with regard to underwriting philosophies, claims processing procedures and safety services;
      (f) Monitor insurers' compliance with requirements for filing required forms, and review debit and credit schedule rate filings under RSA 412:28, I;
      (g) Review medical and indemnity deductible rate filings, required under RSA 412:31.
   VII. The commissioner shall appoint, as the commissioner's assistants, a health care policy analyst, a health care statistician, a general counsel, an insurance fraud attorney, a senior insurance fraud investigator, an assistant property and casualty actuary, and a compliance and enforcement counsel, each of whom shall serve at the pleasure of the commissioner during good behavior. The health care policy analyst, health care statistician, general counsel, insurance fraud attorney, senior insurance fraud investigator, assistant property and casualty actuary, and compliance and enforcement counsel shall perform such duties and exercise such powers as the commissioner may authorize.
