454.326  Misrepresentation by use of telephone to obtain dangerous drug; penalty.  A person who, in order to obtain any dangerous drug, falsely represents himself or herself in a telephone conversation with a pharmacist to be a physician or other person who can lawfully prescribe such drugs or to be acting on behalf of a person who can lawfully prescribe drugs:

      1.  For the first offense, is guilty of a misdemeanor.

      2.  For any subsequent offense, is guilty of a category E felony and shall be punished as provided in NRS 193.130.
