171.128 Magistrate may order arrest for committing or attempting to commit offense in magistrate’s presence. A magistrate may orally order a peace officer or private person to arrest anyone committing or attempting to commit a public offense in the presence of the magistrate, and may thereupon proceed as if the offender had been brought before the magistrate on a warrant of arrest.
