81-2,162.28. Preemption of local law.The NebraskaCommercial Fertilizer and Soil Conditioner Act and any rules and regulationsadopted and promulgated thereunder shall supersede and preempt any ordinance,rule, regulation, or resolution enacted by any political subdivision of thestate regarding the regulation of fertilizer and soil conditioners. No politicalsubdivision shall prohibit or in any other manner regulate any matter relatingto the registration, labeling, or sale of fertilizer and soil conditioners.No political subdivision shall prohibit or in any other manner regulate anymatter relating to the storage, transportation, distribution, notificationof use, or use that is in addition to or in conflict with the Nebraska CommercialFertilizer and Soil Conditioner Act and any rules and regulations adoptedand promulgated thereunder. Nothing in this section shall be construed topreempt or otherwise limit the authority of any city or county to adopt andenforce zoning regulations or any natural resources district to enforce theNebraska Ground Water Management and Protection Act.
