Disclosure of absence to be made, when, to whom.
630.150. 1. Except as provided in subsection 2 of this section, whena patient, resident or client is absent due to his unauthorizeddisappearance from a residential facility or day program, or hiswhereabouts are unknown and disclosure is necessary for the protection ofthe patient, resident or others, and the provisions of section 630.140would otherwise be applicable, notice of the disappearance, along withrelevant information, may be made to relatives, governmental lawenforcement agencies and other persons if necessary for the protection ofthe patient, resident or other parties, as designated by the head of thefacility or program or physician in charge of the patient, resident orclient.
2. If the patient, resident or client was committed to the custody ofthe department of mental health pursuant to chapter 552, RSMo, and thatpatient, resident or client is absent due to an unauthorized disappearancefrom a residential facility or day program, or such person's whereaboutsare unknown, the head of the mental health facility or a designee shallimmediately give notice of the disappearance, along with relevantinformation, to the prosecutor and sheriff of the county wherein thecommitted person is detained, the prosecutor and sheriff of the countywherein the committed person was tried and acquitted, all known survivingvictims as defined in chapter 595, RSMo, any other agencies or personsdesignated by the head of the facility as necessary for the protection ofthe patient, resident or other parties.
