Persons confined to jail, verification of lawful immigration statusrequired.
577.680. 1. If verification of the nationality or lawful immigrationstatus of any person who is charged and confined to jail for any period oftime cannot be made from documents in the possession of the prisoner orafter a reasonable effort on the part of the arresting agency to determinethe nationality or immigration status of the person so confined,verification shall be made by the arresting agency within forty-eight hoursthrough a query to the Law Enforcement Support Center (LESC) of the UnitedStates Department of Homeland Security or other office or agency designatedfor that purpose by the United States Department of Homeland Security. Ifit is determined that the prisoner is in the United States unlawfully, thearresting agency shall notify the United States Department of HomelandSecurity. Until August 28, 2009, this section shall only apply to officersemployed by the department of public safety to include: the highwaypatrol, water patrol, capitol police, fire marshal's office, and divisionof alcohol and tobacco control.
2. Nothing in this section shall be construed to deny any person bondor prevent a person from being released from confinement if such person isotherwise eligible for release.
