When parties claim adversely, court shall proceed, how.
528.190. Whenever it shall appear in any proceeding inpartition that there are parties claiming the same portionadversely to each other, the court may either decide upon suchadverse claims, or, in its discretion, direct the share or sharesso in controversy to be set off and allotted, subject to theclaims of the parties in controversy against each other.
