Officer liable on his bond for refusal to perform duty.
513.345. If any officer to whom any execution shall bedelivered shall not return the same according to law and thecommand of the writ, such officer and his sureties shall beliable to pay the damages sustained by such default, to berecovered by the party aggrieved, by action upon the officialbond of the officer, or by civil action against such officer.
