Duties of the division of child support enforcement.
454.408. The division of child support enforcement:
(1) Shall determine whether a person who has applied for or isreceiving assistance from a program funded pursuant to Part A or Part E ofTitle IV of the Social Security Act, Title XIX of the Social Security Actor the Food Stamp Act is cooperating in good faith with the division inestablishing the paternity of, or in establishing, modifying or enforcing asupport order for any child of such person by providing the division withthe name of the noncustodial parent or any other information the divisionmay require. The division may, by regulation, excuse compliance with theprovisions of this subsection on a case-by-case basis for good cause orother exceptions as the division may deem to be in the best interest of thechild;
(2) Shall require as a condition of cooperation that such personsupply additional information deemed necessary by the division and appearat any interviews, hearings or legal proceedings;
(3) Shall require as a condition of cooperation that such person andsuch person's child submit to genetic testing pursuant to a judicial oradministrative order;
(4) May request that such person sign a voluntary acknowledgment ofpaternity, after notice of the rights and consequences of such anacknowledgment, but may not require such person to sign an acknowledgmentor otherwise relinquish the right to a genetic test as a condition ofcooperation and eligibility for assistance from a state program fundedpursuant to Part A or Part E of Title IV of the Social Security Act, TitleXIX of the Social Security Act or the Food Stamp Act; and
(5) Shall promptly notify such person, the division of familyservices or the division of medical services of every determination madepursuant to this section, including a determination that such person is notcooperative and the basis for such determination.
