Condemnation proceedings, board of managers to represent all unitowners.
448.195. Whenever the state, a political subdivision, or anyother corporation, agency, or authority having the power ofeminent domain shall seek to acquire any of the common elementsof condominium property, such authority may conduct negotiationswith the board of managers as representatives of all unit owners,and the said board of managers may execute and deliver theappropriate conveyance on behalf of all owners in return for theagreed consideration. Said board of managers shall allocate suchconsideration, whether received through negotiation orcondemnation, to the common elements or to unit owners inproportion to their respective interests. In the eventnegotiations shall fail, the condemning authority may join theboard of managers as party defendants in lieu of naming all unitowners having an interest in the common elements, and suchproceedings shall bind all unit owners; however, any unit ownerhaving an interest in the common elements may be made a partydefendant in such proceedings.
