448.050. 1. Upon compliance with sections 448.020, 448.030and 448.040, and upon recording of the declaration and plat, theproperty shall become subject to the provisions of sections448.005 to 448.210, and all units shall thereupon be capable ofownership in fee simple or any lesser estate, and may thereafterbe conveyed, leased, mortgaged or otherwise dealt with in thesame manner as other real property, but subject, however, to thelimitations imposed by sections 448.005 to 448.210.
2. Each unit owner shall be entitled to the percentage ofownership in the common elements appertaining to such unit ascomputed and set forth in the declaration pursuant to subdivision(3) of section 448.030, and ownership of such unit and of theowner's corresponding percentage of ownership in the commonelements shall not be separated, nor shall any unit, by deed,plat, court decree or otherwise, be subdivided or in any othermanner separated into tracts or parcels smaller than the wholeunit as shown on the plat.
