Public health hazards--actions to abate, procedure.
444.935. The general assembly declares that voids, and openand abandoned tunnels, shafts, and entryways resulting from anyprevious mining operation constitute a hazard to the publichealth or safety and that surface impacts of any underground orsurface mining operation may degrade the environment. Thegovernor is authorized to request the appropriate federal officerunder federal programs to fill such voids, seal such abandonedtunnels, shafts, and entryways, and reclaim surface impacts ofunderground mines which could endanger life and property,constitute a hazard to the public's health and safety, or degradethe environment. The commission is authorized to carry out suchwork pursuant to an approved abandoned mine reclamation programand with funds available for use in carrying out the purpose ofthis section from federal moneys received.
