Application for release from bond--objection, effect of--appeal.
444.650. 1. Prior to release of the bond or any portionthereof, application shall be made by the operator to thecommission, either with the completion reports or subsequent tosuch reports, for release of the bond.
2. If the commission determines that the bond, or anyportion thereof, should be released, an order may be so issuedwithout hearing, unless there is filed with the commission withinthirty days of the date the application for release is filed, byan aggrieved party, a petition in opposition to release of thebond. In such case the commission shall hold a hearing asprovided in section 444.680 and enter such order as shall beappropriate.
3. If the commission determines that the bond, or anyportion thereof, should not be released, the commission shallissue an order to that effect with the reasons for the order andshall give notice to the operator. A hearing shall be held bythe commission as provided in section 444.680 if requested by theoperator within thirty days of the date of notice of the order.At such hearing burden of proof shall be on the operator. Afterhearing, the commission shall enter such order as shall beappropriate and shall give notice to the operator.
4. Appeal may be taken as provided in section 444.700, byany party to the proceeding, from any order issued pursuant tothis section.
