Board to maintain certain personal information aboutpurchaser--confidentiality of information.
436.525. The board shall maintain as a closed and confidentialrecord, not subject to discovery unless the person provides written consentfor disclosure, all personal information about any individual preneedpurchaser or beneficiary, including but not limited to name, address,Social Security number, financial institution account numbers, and anyhealth information disclosed in the preneed contract or any documentprepared in conjunction with the preneed contract; provided, however, thatthe board may disclose such confidential information without the consent ofthe person involved in the course of voluntary interstate exchange ofinformation; or in the course of any litigation concerning that person orthe provider, seller, or sales agent involved with the preneed contract; orpursuant to a lawful request or to other administrative or law enforcementagencies acting within the scope of their statutory authority. In anysuch litigation, the board and its attorneys shall take reasonableprecautions to ensure the protection of such information from disclosure tothe public.
