Percentage requirements, how state agencies to comply.
414.415. State agencies may meet the percentage requirements ofsections 414.410 to 414.415 through purchase of original equipmentmanufactured alternative fuel vehicles or the conversion of vehicles, inaccordance with federal and state requirements and applicable safety laws.Vehicles purchased pursuant to sections 414.410 to 414.415 shall not exceedthe cost of conventional fuel vehicles of the same make and model by morethan ten percent, using life cycle costing methods calculated pursuant tocriteria in subsection 3 of section 414.400, except that vehicles purchasedpursuant to sections 414.410 to 414.415 that are based for the life of thevehicle and used primarily in maintenance and nonattainment areas definedwith regard to the National Ambient Air Quality Standards of the federalClean Air Act, as amended, 42 U.S.C. 7401 et seq., shall not exceed suchcost of conventional fuel vehicles of the same make and model by more thanseventeen percent. The commissioner of administration in purchasing,leasing, maintaining or converting vehicles for alternative fuels use shallcomply with all applicable safety standards promulgated by the UnitedStates Department of Transportation.
