Investigations by attorney general--investigative demand, howserved--injunction, procedure.
407.472. 1. When it appears to the attorney general that a personhas engaged in, is engaging in or is about to engage in any method, use,act or practice declared to be unlawful by sections 407.450 to 407.478, orwhen it appears that any funds solicited by or on behalf of any charitableorganization are being used, or are about to be used, for any purpose inviolation of this chapter or section 576.080, RSMo, or when he or shebelieves it to be in the public interest that an investigation should bemade to ascertain whether a person in fact has engaged in, is engaging in,or is about to engage in any such act or practice he or she may issue andcause to be served a civil investigative demand to assist in theinvestigation of the matter. The issuance and enforcement of each civilinvestigative demand shall be in compliance with all of the terms andprovisions of sections 407.040 to 407.090.
2. Whenever it appears to the attorney general that a person hasengaged in, is engaging in, or is about to engage in any method, use, act,or practice declared to be unlawful by sections 407.450 to 407.478, or whenit appears that any funds solicited by or on behalf of any charitableorganization are being used, or are about to be used, for any purpose inviolation of this chapter or section 576.080, RSMo, he or she may bring anaction pursuant to section 407.100 for an injunction prohibiting suchperson from continuing such methods, uses, acts, or practices, or engagingtherein, or doing anything in furtherance thereof. In any action broughtby the attorney general pursuant to this subsection all of the provisionsof sections 407.100 to 407.140 shall apply thereto.
