376.775. 1. No policy of accident and sickness insurance shall bedelivered or issued for delivery to any person in this state unless:
(1) The entire money and other considerations therefor are expressedtherein; and
(2) The time at which the insurance takes effect and terminates isexpressed therein, except that if the policy is delivered subject to thecondition that it shall take effect when the first premium is accepted by theinsurer, the time at which the insurance takes effect and terminates may beexpressed in the insurer's executed premium receipt which shall by referencebe made a part of the policy; and
(3) It purports to insure only one person, except that a policy mayinsure, originally or by subsequent amendment, upon the application of anadult member of a family who shall be deemed to be the policyholder, any twoor more eligible members of that family, including husband, wife, dependentchildren or any children under a specified age which shall not exceed nineteenyears and any other person dependent upon the policyholder; and
(4) The style, arrangement and overall appearance of the policy give noundue prominence to any portion of the text, and unless every printed portionof the text of the policy and of any endorsements or attached papers isplainly printed in lightfaced type of a style in general use, the size ofwhich shall be uniform and not less than ten-point with a lowercase unspacedalphabet length not less than one hundred and twenty-point (the "text" shallinclude all printed matter except the name and address of the insurer, name ortitle of the policy, the brief description, if any, and captions andsubcaptions); and
(5) The exceptions and reductions of indemnity are set forth in thepolicy and, except those which are set forth in section 376.777, are printed,at the insurer's option, either included with the benefit provision to whichthey apply, or under an appropriate caption such as "EXCEPTIONS", or"EXCEPTIONS AND REDUCTIONS", provided that if an exception or reductionspecifically applies only to a particular benefit of the policy, a statementof such exception or reduction shall be included with the benefit provision towhich it applies; and
(6) Each such form, including riders and endorsements, shall beidentified by a form number in the lower left-hand corner of the first pagethereof; and
(7) It* contains no provision purporting to make any portion of thecharter, rules, constitution, or bylaws of the insurer a part of the policyunless such portion is set forth in full in the policy, except in the case ofthe incorporation of, or reference to, a statement of rates or classificationof risks, or short-rate table filed with the director of the department ofinsurance, financial institutions and professional registration.
2. If any policy is issued by an insurer domiciled in this state fordelivery to a person residing in another state, and if the official havingresponsibility for the administration of the insurance laws of such otherstate shall have advised the director of the department of insurance,financial institutions and professional registration that any such policy isnot subject to approval or disapproval by such official, the director of thedepartment of insurance, financial institutions and professional registrationmay by ruling require that such policy meet the standards set forth insubsection 1 of this section and in section 376.777.
