Notification by agent of intention to apprehend--local lawenforcement may accompany agent--violations, penalties.

374.757. 1. Any agent licensed by sections 374.695 to 374.775 whointends to apprehend any person in this state shall inform law enforcementauthorities in the city or county in which such agent intends suchapprehension, before attempting such apprehension. Such agent shallpresent to the local law enforcement authorities a certified copy of thebond and all other appropriate paperwork identifying the principal and theperson to be apprehended. Local law enforcement may accompany the agent.Failure of any agent to whom this section applies to comply with theprovisions of this section shall be a class A misdemeanor for the firstviolation and a class D felony for subsequent violations; and shall also bea violation of section 374.755 and may in addition be punished pursuant tothat section.

2. The surety recovery agent shall inform the local law enforcementin the county or city where such agent is planning to enter a residence.Such agent shall have a certified copy of the bond and all appropriatepaperwork to identify the principal. Local law enforcement, when notified,may accompany the surety recovery agent to that location to keep the peaceif an active warrant is effective for a felony or misdemeanor. If awarrant is not active, the local law enforcement officers may accompany thesurety recovery agent to such location. Failure to report to the local lawenforcement agency is a class A misdemeanor. For any subsequentviolations, failure to report to the local law enforcement agency is aclass D felony.
