Practice of veterinary medicine across state lines defined--licensenot required, when.
340.217. 1. No person registered as a veterinarian in Missouri shallengage in the practice of veterinary medicine, as authorized in thischapter, across state lines, except as herein provided.
2. For purposes of this chapter, the "practice of veterinary medicineacross state lines" means:
(1) The rendering of a written or otherwise documented veterinarymedical opinion concerning the diagnosis or treatment of a patient withinthis state by a veterinarian located outside this state as a result oftransmission of individual patient data by electronic, telephonic, or othermeans from within this state or any other state to such veterinarian orveterinarian's agent; or
(2) The rendering of treatment to a patient within this state by aveterinarian located outside this state as a result of transmission ofindividual patient data by electronic, telephonic, or other means fromwithin this state or any other state to such veterinarian or veterinarian'sagent.
3. A veterinarian located outside this state shall not be required toobtain a license when:
(1) In consultation with a veterinarian licensed to practiceveterinary medicine in this state; and
(2) The veterinarian licensed in this state retains the ultimateauthority and responsibility for the diagnosis and/or treatment in the careof the patient located within this state; or
(3) Evaluating a patient or rendering an oral, written, or otherwisedocumented veterinary medical opinion when providing testimony or recordsfor the purpose of any civil or criminal action before any judicial oradministrative proceeding in this state or other forum in this state.
