334.050. 1. There is hereby established in the office ofthe state treasurer a fund to be known as the "Board ofRegistration for the Healing Arts Fund". All fees of any kindand character authorized to be charged by the board shall becollected by the director of the division of professionalregistration and shall be transmitted to the department ofrevenue for deposit in the state treasury for credit to thisfund, to be disbursed only in payment of expenses of maintainingthe board and for the enforcement of the provisions of lawconcerning professions regulated by the board; and no other moneyshall be paid out of the state treasury for carrying out theseprovisions. Warrants shall be issued on the state treasurer forpayment out of said fund.
2. The provisions of section 33.080, RSMo, to the contrarynotwithstanding, money in this fund shall not be transferred andplaced to the credit of general revenue until the amount in thefund at the end of the biennium exceeds two times the amount ofthe appropriation from the board's funds for the preceding fiscalyear or, if the board requires by rule permit renewal lessfrequently than yearly, then three times the appropriation fromthe board's funds for the preceding fiscal year. The amount, ifany, in the fund which shall lapse is that amount in the fundwhich exceeds the appropriate multiple of the appropriations fromthe board's funds for the preceding fiscal year.
3. The board shall charge each person applying to andappearing before it for examination for certificate of licensureto practice as physician and surgeon, an examination fee. Shouldthe examination prove unsatisfactory and the board refuse toissue a license thereon, the applicant failing to pass theexamination may return to any meeting and be examined uponpayment of a reexamination fee.
