Rules authorized--promotion of patrolmen, general order ofcommissioner to establish circumstances for.
306.230. 1. The commissioner shall prescribe rules for instructionand discipline and make all administrative rules and regulations and fixthe hours of duty for the members of the patrol. Any rule or portion of arule, as that term is defined in section 536.010, RSMo, that is createdunder the authority delegated in this section shall become effective onlyif it complies with and is subject to all of the provisions of chapter 536,RSMo, and, if applicable, section 536.028, RSMo. This section and chapter536, RSMo, are nonseverable and if any of the powers vested with thegeneral assembly under chapter 536, RSMo, to review, to delay the effectivedate, or to disapprove and annul a rule are subsequently heldunconstitutional, then the grant of rulemaking authority and any ruleproposed or adopted after August 28, 2007, shall be invalid and void. Thecommissioner shall divide the state into districts and assign members ofthe patrol to such districts in a manner deemed proper to carry out thepurposes of this chapter. The commissioner may call members of the patrolfrom one district to another.
2. The commissioner may, by general order, establish for thecircumstances under which members of the patrol are promoted. Thecommissioner shall classify and, by promotion, increase the rank oflieutenant colonels, majors, captains, lieutenants, sergeants, corporals,patrolmen, and radio personnel from the next lower rank after not less thanone year of service satisfactorily performed therein. If the commissionerfinds the candidate pool to fill a position through promotion is notsufficient from which to select, the commissioner may promote an individualfrom the next lower rank.
